Welcome to Gay Men Online Community (“GMO,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, platform, software, applications, and related services (collectively, the “Services”).

By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Eligibility and Age Restriction

The Services are intended only for adults.

You must be at least 18 years old to access or use GMO. By using the Services, you represent and warrant that:

  • you are at least 18 years old;
  • you have the legal capacity to enter into these Terms; and
  • your use of the Services does not violate any applicable law or regulation.

We strictly prohibit minors from accessing the platform. Any account found to be owned or operated by a person under 18 may be suspended or terminated immediately.

2. Nature of the Platform

GMO is an adult LGBT online community platform. The Services may allow users to create profiles, post content, upload media, participate in discussions, send messages, and interact with other members.

We provide the platform as a venue for user interaction. We do not guarantee the identity, intentions, legitimacy, or conduct of any user.

3. Account Registration and Security

To access certain features, you may be required to create an account. You agree to:

  • provide accurate, current, and complete information;
  • keep your login credentials confidential;
  • maintain and promptly update your account information; and
  • accept responsibility for all activities that occur under your account.

You may not:

  • create an account using false or misleading information;
  • impersonate another person or entity;
  • create multiple accounts to evade moderation or enforcement actions;
  • sell, transfer, or share your account with another person.

You must notify us promptly if you believe your account has been compromised.

4. Acceptable Use

You agree to use the Services only in a lawful, respectful, and non-abusive manner.

You may not use GMO to:

  • violate any law, regulation, or third-party right;
  • harass, stalk, threaten, defraud, or intimidate another user;
  • post defamatory, fraudulent, misleading, or deceptive content;
  • exploit, harm, or attempt to contact minors;
  • distribute spam, malware, viruses, bots, or harmful code;
  • scrape, crawl, copy, or harvest user data without authorization;
  • interfere with the security or operation of the Services;
  • promote illegal activity, violence, trafficking, or exploitation;
  • evade bans, suspensions, or moderation decisions.

5. User Content and Uploads

The Services may allow you to upload, post, share, transmit, or otherwise make available text, images, videos, profile information, comments, messages, and other materials (“User Content”).

You are solely responsible for your User Content and for the consequences of posting or sharing it.

By posting User Content, you represent and warrant that:

  • you own the content or have all necessary rights, licenses, consents, and permissions to use and share it;
  • the content does not violate any law or infringe any third-party right;
  • every person depicted in sexually explicit or nude content is at least 18 years old;
  • any required consent has been obtained from persons appearing in the content;
  • the content is accurate insofar as it identifies you or others.

You retain ownership of your User Content, but you grant GMO a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, moderate, and otherwise use that content as necessary to operate, improve, and enforce the Services.

6. Prohibited Content

You may not post, upload, transmit, or share any content that:

  • depicts or exploits minors in any way;
  • involves non-consensual sexual content or intimate imagery;
  • promotes or depicts sexual violence, coercion, assault, or exploitation;
  • violates revenge porn laws or privacy rights;
  • is obscene or unlawful under applicable law;
  • infringes copyright, trademark, publicity, privacy, or other rights;
  • contains hate speech, credible threats, or targeted harassment;
  • promotes self-harm, terrorism, trafficking, or criminal activity;
  • includes malicious software, phishing links, or fraudulent schemes;
  • falsely represents identity, affiliation, age, or consent.

Any content involving minors or suspected child sexual abuse material will be removed immediately and may be reported to law enforcement or other appropriate authorities.

7. Adult Content Rules

Because GMO is an adult platform, some adult-oriented expression may be allowed, subject to these Terms and applicable law. Even where adult content is allowed, the following are strictly prohibited:

  • content involving anyone under 18;
  • content lacking consent;
  • secretly recorded intimate content;
  • prostitution, escorting, or sex trafficking promotion where prohibited by law;
  • sexual extortion or coercion;
  • incest, bestiality, or other unlawful sexual content;
  • content that violates payment processor, app platform, hosting provider, or legal requirements applicable to GMO.

We may restrict, label, blur, age-gate, remove, or disable access to adult content at our discretion.

8. Messaging and Community Conduct

If private messages, chat, comments, forums, or other communication features are available, you agree to use them respectfully.

You may not:

  • send unsolicited sexual messages where unwelcome;
  • repeatedly contact users after being asked to stop;
  • use racist, homophobic, transphobic, abusive, or degrading language to harass others;
  • blackmail, dox, or expose private information;
  • solicit passwords, financial information, or off-platform sensitive data for fraud;
  • organize brigading, impersonation, or targeted abuse.

Users are responsible for their own interactions. Exercise caution when communicating with others or meeting anyone offline.

9. Moderation and Enforcement

We reserve the right, but not the obligation, to monitor, review, screen, remove, restrict, edit, or disable access to content or accounts at our sole discretion.

We may take action without prior notice if we believe content or conduct:

  • violates these Terms;
  • creates legal risk for GMO;
  • harms users, third parties, or the community;
  • is inappropriate, abusive, deceptive, or unsafe.

Enforcement actions may include:

  • content removal;
  • warnings;
  • temporary restrictions;
  • account suspension;
  • account termination;
  • IP or device blocking;
  • reporting to law enforcement or relevant authorities.

We are not required to explain every moderation decision, though we may do so when appropriate.

10. Reporting Violations

Users may report content or behavior that appears to violate these Terms. We may investigate reports and take any action we consider appropriate.

Submitting false, malicious, or abusive reports may itself violate these Terms.

11. Privacy and Safety

Your use of the Services is also subject to our Privacy Policy. You understand that information you choose to share on your profile or through the Services may be visible to others.

You should never post or transmit sensitive personal information you do not want disclosed, including:

  • home address;
  • financial account information;
  • government identification numbers;
  • workplace details you want kept private;
  • another person’s private information without consent.

We encourage users to protect their privacy and use caution in all interactions.

12. Copyright and Intellectual Property

GMO respects intellectual property rights. You may not post content that infringes the rights of others.

If you believe content on GMO infringes your copyright or other rights, you may submit a complaint with sufficient detail for us to review the matter. We may remove allegedly infringing content and may terminate repeat infringers where appropriate.

13. Termination

You may stop using the Services at any time.

We may suspend, restrict, or terminate your account or access at any time, with or without notice, for any reason, including if we believe you violated these Terms, applicable law, or community safety standards.

Upon termination, your right to use the Services ends immediately. We may retain certain information as required by law, for legitimate business purposes, or for safety and enforcement purposes.

14. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, GMO disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and security.

We do not guarantee:

  • uninterrupted or error-free operation;
  • that the platform will always be secure;
  • that user content will be accurate or reliable;
  • that interactions with other users will be safe, lawful, or satisfactory.

15. Limitation of Liability

To the fullest extent permitted by law, GMO and its owners, operators, affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, reputation, or business, arising out of or related to your use of the Services.

Our total liability for any claim arising out of or relating to the Services shall not exceed the greater of:

  • the amount you paid us, if any, in the 12 months before the claim arose; or
  • $100 USD.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless GMO and its owners, operators, affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • your use of the Services;
  • your User Content;
  • your violation of these Terms;
  • your violation of any law or third-party rights.

17. Changes to the Services or Terms

We may modify, suspend, or discontinue any part of the Services at any time.

We may also update these Terms from time to time. When we do, we will post the updated version with a new effective date. Your continued use of the Services after updated Terms are posted constitutes your acceptance of those changes.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GMO operates, without regard to conflict of laws principles.

Any dispute arising out of or relating to these Terms or the Services shall be brought in the appropriate courts located in that jurisdiction, unless applicable law requires otherwise.

19. Severability

If any provision of these Terms is found unenforceable or invalid, the remaining provisions will remain in full force and effect.
